Acknowledgment and Release of Liability
Rustic Antler Market, a trade name of High Desert Hospitality, LLC
Acceptance of Risk:
By purchasing, receiving, handling, displaying, installing, or otherwise using any antlers, mounts, or wildlife materials sold by Rustic Antler Market, a trade name of High Desert Hospitality, LLC (the “Company”), the purchaser acknowledges that these products are natural materials with inherent risks.
Antlers are rigid, heavy, irregular in shape, and may include sharp points, edges, or protrusions. Improper handling, installation, placement, or misuse may result in serious personal injury, property damage, or death.
The purchaser knowingly and voluntarily assumes all risks associated with the possession, use, handling, transport, display, or installation of these products.
Release of Liability:
To the fullest extent permitted by law, the purchaser agrees to release, waive, discharge, and hold harmless the Company, including High Desert Hospitality, LLC doing business as Rustic Antler Market, and its owners, members, officers, employees, contractors, affiliates, successors, and assigns from any and all claims, demands, actions, damages, losses, liabilities, costs, or expenses arising from or related to:
• Personal injury or death
• Property damage
• Accidents or incidents of any kind
• Improper or unintended use
• Failure to properly secure or mount products
• Interaction by third parties
• Any misuse, modification, or alteration of the product
This release applies whether such claims arise from negligence, accident, misuse, or unforeseen circumstances, except where prohibited by law.
Installation and Display Responsibility:
The Company does not provide installation services unless expressly stated in writing. The purchaser is solely responsible for ensuring that all mounts and antlers are securely installed using appropriate hardware, wall structure, and mounting methods suitable for the weight, size, and design of the piece.
Professional installation is strongly recommended.
The Company is not responsible for injuries, damages, or losses resulting from improper installation, hardware failure, or inadequate structural support.
Use Around Children and Animals
Antlers and antler mounts should be kept out of reach of children and animals. These products are decorative objects and are not toys.
The purchaser accepts full responsibility for ensuring safe placement, supervision, and use in any environment where others may interact with the product.
Natural Material Disclosure
The purchaser acknowledges that antlers are natural materials and may exhibit variations in texture, density, coloration, surface finish, and structural characteristics. These natural variations are inherent to the material and do not constitute defects or create liability for the Company.
No Warranty of Safety
The Company makes no warranty, express or implied, regarding the safety of antlers or mounts under all conditions. Safe use depends on proper handling, installation, placement, and ongoing care by the purchaser.
Governing Law
This acknowledgment and release shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict of law principles.
Binding Agreement
By completing a purchase, accepting delivery, or taking possession of any product from the Company, the purchaser confirms that they have read, understood, and voluntarily agreed to this Acknowledgment and Release of Liability.
